1. Overview
Welcome to Kreate by Design LLC (“KXD,” “we,” “our,” or “us”).
By using our website or working with us, you agree to these Terms & Conditions. They’re built to protect both our agency and our clients — ensuring every partnership operates with clarity, fairness, and precision.
2. Services
KXD provides creative direction, brand development, web design, and digital strategy.
Each engagement is governed by a formal proposal or contract outlining specific deliverables, timelines, and fees.
We reserve the right to refine or adjust our services as we evolve to maintain the highest creative standard.
3. Intellectual Property
All content, visuals, code, and design elements created by KXD remain the property of Kreate by Design LLC until payment is complete.
Upon full payment, clients receive the rights to use all final approved deliverables.
KXD retains the right to showcase completed work for portfolio and promotional use unless otherwise agreed in writing.
4. Client Responsibilities
We build in partnership. Clients agree to provide accurate information, timely feedback, and prompt communication.
Delays in approvals or deliverables may affect project timelines and costs.
5. Payments & Terms
All payments follow the terms in each proposal or invoice.
Deposits are non-refundable.
Final deliverables transfer only after full payment is received.
Late or missed payments may result in paused work or additional fees as outlined in your agreement.
6. Confidentiality
We value discretion. All client materials, brand assets, and communications remain confidential and are shared only with authorized KXD team members.
7. Limitation of Liability
KXD is not responsible for indirect or consequential losses resulting from the use of our website, services, or third-party tools.
Our total liability shall not exceed the amount paid for the specific project or service.
8. Revisions & Scope Adjustments
Revisions are defined in your proposal.
Additional requests beyond scope will be quoted separately and approved in writing before execution.
9. Termination
Either party may terminate the relationship with written notice.
All payments made are non-refundable. Work completed up to the termination date remains the property of KXD until paid in full.
10. Third-Party Integrations
Our work may involve integrations with trusted partners such as Google Analytics, Calendly, ClickUp, or RingDrip.
We are not responsible for performance or policy changes on those external platforms.
11. Governing Law
These Terms are governed by the laws of the State of California, with jurisdiction in Los Angeles County.
12. Updates
KXD may update these Terms to align with evolving standards. The “Effective Date” reflects the most recent version.
